This is a full-day CLE addressing topics related to victims of violent crime. We will discuss the effects of trauma, current trends in the
human trafficking movement, the Uniform Child Custody Jurisdiction Act, best
practices on protection orders in the new criminal courts and paternity courts,
common issues in representation of immigrant crime victims who are involved in
a criminal case, and more.

9:00-10:00am Human Trafficking: Update and Issues: Abigail Kuzma, Assistant Attorney General, Chief Counsel for the Division of Victim Services and Outreach, Office of the Indiana Attorney General
This presentation will cover definitions of human trafficking, current trends in representing survivors of trafficking, and issues attorneys may face throughout their representation of a survivor.
10:00-11:00am Arguing Jurisdiction: The UCCJEA & Best Practices in Representing Survivors: Kerry Hyatt Bennett, Legal Counsel, Indiana Coalition Against Domestic Violence
This presentation will help attorneys understand the Uniform Child Custody Jurisdiction Act and what it means for survivors of domestic violence.
11:00-12:00pm The Effects of Trauma on Victims of Violent Crime: Sarah Clark, MSW/LSW
When working with clients who have experienced violent crime it is important to understand how that trauma affects behaviors, thinking, and understanding of the crime. Attorneys should be informed of the best practices in order to effectively represent victims of trauma.

This panel discussion will include discussions on various issues that low income clients often face that may be outside of the initial realm of consideration for a victim of violence. Topics include: bankruptcy, landlord/tenant issues, and expungement.

This presentation will be a legal /theoretical overview of protection orders, current trends in both criminal and paternity courts, and common deviations occurring based on court-specific practices.

2:45-3:45pm Immigration, Criminal Law, and Serving Crime Victims: Kevin Muñoz, Immigration Attorney
This presentation will discuss the intersection of immigration law and criminal cases as it relates to victims of crime.
3:45-4:45pm Some Ethical Considerations When Your Client is Also a Survivor of Domestic Violence, Sexual Assault or Stalking: Ruth Reichard, Family Violence Resource Attorney, Indiana Supreme Court Office of Judicial Administration
This session will introduce lawyers to issues that may arise when their clients are also victims of intimate partner violence, sexual abuse, or stalking. These issues include whether laws mandating the reporting of child maltreatment or endangered adult abuse/neglect outweigh the attorney-client privilege; options for responding when a client indicates a reluctance to obey a subpoena in the criminal case or otherwise cooperate with the prosecution; and, the importance of risk assessment and safety planning to ensure that your encounters with the client are safe for all participants. We will also review the resources available to lawyers who represent victims of crime – you don’t have to go it alone!
